Terms of Service

These Terms of Service govern your use of the services provided by Syba Digital. By purchasing any of our services or accessing our website, you agree to be bound by these Terms.

1. Services We Offer

Syba Digital provides the following services:

  • Website Builds: Pre-priced website packages built using optimized templates and customized with your content, branding, and preferences.
  • Website Hosting & Maintenance: Ongoing WordPress hosting, updates, security, performance optimization, and revisions for active clients, according to the selected plan.
  • Website Consulting & Management: Ongoing support and hands-on management for clients with existing websites, including edits, audits, troubleshooting, and migration services.

We reserve the right to update or modify our service offerings at any time. Details of what is included in each package or plan are listed on our Pricing page.

2. Orders & Onboarding

Before placing an order for a website build, we strongly recommend booking a consultation call to ensure clarity and alignment.

Once an order is placed:

  • You will receive a confirmation email
  • You will be added to our project management system (Basecamp)
  • You will be asked to complete a Content Gathering Checklist
  • Work begins once all required information and materials are received

3. Turnaround Time

We aim to deliver website builds within three (3) business days of receiving a completed Content Gathering Checklist.

Delivery timelines may vary depending on project complexity, responsiveness during review rounds, or delays caused by missing content or approvals.

4. Client Responsibilities

Clients are responsible for:

  • Providing accurate and timely content, feedback, and access credentials
  • Reviewing and approving work within reasonable timelines
  • Ensuring they own or have rights to any content submitted (logos, text, images, media)

Delays caused by missing materials or feedback may impact delivery timelines and do not constitute a breach of this agreement.

5. Revisions Policy

  • Website Builds include one (1) round of revisions by default.
  • Additional revisions require an active Hosting & Maintenance plan.

Certain Hosting & Maintenance and Consulting & Management plans include unlimited edits or revisions. Unlimited edits are intended for reasonable ongoing updates and maintenance within the existing structure of the website.

Examples of unlimited edits may include:

  • Text changes
  • Image replacements
  • Updating existing page content
  • Layout adjustments within existing page structures
  • Blog publishing included in the selected plan
  • Updating contact details or business information
  • Minor styling adjustments

Unlimited edits do not include:

  • Full website redesigns
  • Creating large numbers of new pages
  • New page templates or entirely new layouts
  • New custom functionality or feature development
  • Third-party software implementation
  • E-commerce restructuring
  • Migration projects
  • Major strategy or branding overhauls
  • Repeated excessive requests beyond normal business usage
  • Work requiring extensive development or custom coding

Syba Digital reserves the right to determine whether requests fall within the intended scope of an active plan. Requests outside of scope may require a custom quote or separate project agreement.

All revision requests must be submitted via Basecamp or email unless otherwise agreed.

6. Ownership & Intellectual Property

Once payment is complete, you own all final website files, content, and branding created for your project.

You may request a backup or migration of your website at any time.

Syba Digital retains the right to showcase completed projects in its portfolio unless you explicitly request otherwise in writing.

7. Subscription Services

Ongoing services such as Website Hosting & Maintenance and Website Consulting & Management are offered on both monthly and annual recurring billing cycles through WooCommerce Subscriptions.

By purchasing a subscription plan, you authorize recurring charges according to the billing interval selected at checkout.

Monthly subscriptions renew every month. Annual subscriptions renew every twelve (12) months.

Clients may cancel a subscription at any time through their account portal or by contacting support at support@sybadigital.com.

Cancellation prevents future renewals but does not immediately terminate service access. Services remain active until the end of the current paid billing period.

Annual plans are discounted in exchange for a longer commitment period and are subject to the same cancellation terms.

Downgrades, upgrades, or plan changes may require cancellation and re-enrollment in a different plan and may take effect at the start of the next billing cycle.

8. Refund Policy

All sales are final.

We do not offer refunds for:

  • Completed or partially completed work
  • Subscription time already used
  • Unused time remaining on annual subscription plans after cancellation
  • Delays caused by client non-responsiveness or missing materials

If you are unsure whether a service is suitable for your needs, we strongly recommend booking a consultation call before purchasing.

9. Support & Availability

Support is provided via Basecamp and email (support@sybadigital.com) during standard business hours (Monday–Friday).

Critical issues affecting hosted websites are typically addressed within 24 hours.

10. SLA & Performance

For websites hosted and maintained by Syba Digital, we aim to provide reliable infrastructure, ongoing maintenance, and high availability.

While no hosting environment can guarantee uninterrupted service, we target approximately 99.9% uptime for hosted websites and apply security patches, plugin updates, and performance optimizations on a regular basis.

Scheduled maintenance, third-party outages, force majeure events, or issues outside of our control may occasionally impact availability and do not constitute a breach of this agreement.

11. Billing Authorization

By purchasing a recurring subscription, you authorize Syba Digital and its payment processors to automatically charge your selected payment method on each renewal date until canceled.

Clients are responsible for maintaining valid payment information.

Failure to process payment may result in suspension or termination of services.

12. Termination

We reserve the right to suspend or terminate services or accounts that:

  • Violate these Terms
  • Abuse our staff or systems
  • Pose security or operational risks to our infrastructure or other clients

Termination or cancellation of an annual subscription before the end of its billing period does not entitle the client to a prorated refund or reimbursement.

13. Changes to Terms

We may update these Terms from time to time. Any material changes will be posted on this page and, where appropriate, communicated to active clients.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States.
